Let’s Be Clear: Medical vs. Recreational Cannabis

Our series, “Let’s Be Clear,” aims to shed light on commonly misunderstood topics within the dynamic world of cannabis, offering insights and clarity to enthusiasts and newcomers alike.

With the rapid upsurge of new medical and recreational dispensaries, there’s a growing curiosity about the distinctions between medical and recreational cannabis. Essentially, medical cannabis and recreational cannabis are two legal categories of the same substance, differing solely in their intended uses. Medical cannabis, prescribed by a physician, is used to treat a specific, underlying medical condition in the patient, while recreational cannabis is primarily used for leisure and may be purchased by any person over the age of 21 without a doctor’s recommendation. Though distinctions between these two categories can be confusing, it ultimately comes down to grasping their unique legal standings and intended purposes. Speaking of legal statuses, it is important to note that all cannabis remains illegal at the federal level despite its approval in many states.

Medical Cannabis

Cannabis, one of the oldest medicinal substances globally, is experiencing a surge in prominence across the United States as numerous states legalize its medicinal use. Currently, millions of Americans turn to medical cannabis to alleviate a range of conditions, including chronic pain, multiple sclerosis, and chemotherapy-induced nausea. Despite its growing acceptance, medical cannabis operates under much different regulatory standards compared to pharmaceutical medicines. Notably, the Food and Drug Administration (FDA) has yet to endorse any products found in medical cannabis dispensaries. Its approval is limited to Epidiolex, a cannabis-derived medicine recognized for treating a rare childhood epilepsy condition. Access to this particular medication is exclusively granted through a prescription from a medical doctor.

Recreational Cannabis

Adult-use or recreational cannabis refers to laws that allow individuals aged 21 and older to purchase cannabis. Presently, 24 states have embraced adult-use cannabis, treating it similarly to alcohol, though with much more stringent regulations. The consumption of adult-use cannabis typically revolves around its pleasurable mind-altering effects. While THC serves legitimate medical purposes, individuals also consume it for the euphoric sensation it induces. Adding a layer of complexity, many medical patients obtain their cannabis from adult-use dispensaries since it is all the same substance. Consequently, not every customer at a recreational cannabis store is necessarily using the substance solely for non-medical purposes.

The perception of using cannabis to “get high” has traditionally been associated with casual drug use, yet an increasing number of American adults are intentionally incorporating cannabis into their lives to enhance various aspects. Many individuals are recognizing the positive impact that cannabis can have on mental health and spiritual well-being. Recent studies indicate that mindful cannabis use may correlate with making healthier life choices. It has also been identified as a potential enhancer of sexual enjoyment, a viable substitute for alcohol, and even a tool for spiritual practices.

Furthermore, recreational cannabis can be utilized in ways that do not induce a high. This is achievable through products with low levels of THC and higher concentrations of cannabidiol (CBD), a non-intoxicating compound found in cannabis. People are turning to these low-THC products to address injuries, alleviate stress, and manage certain illnesses, despite not being thoroughly assessed. Examples include topical lotions for nerve pain and products designed for relieving menstrual discomfort.

Similarities Between Medical & Recreational

Medical cannabis and adult-use cannabis share more similarities than differences. Contrary to popular belief, the quality of medicinal and recreational cannabis is not inherently distinct, challenging the perception that “medical marijuana” implies a superior product. However, the absence of national regulations for cannabis, including safety standards for pesticides or heavy metals, leads to varying quality from state to state. Most states require testing for pesticides and cannabinoid potency (such as THC percentages) for both medical and adult-use cannabis. It’s important to note that neither category of cannabis is inherently more potent or derived from a different plant. The process by which the plant is cultivated is identical between medical and recreational cultivators.

Differences Between Medical & Recreational

While medical and recreational cannabis stem from the same plant, their paths diverge significantly when it comes to legalities, taxation, and accessibility.

Legal Access and Regulation: Medical cannabis patients must navigate a more regulated pathway to access cannabis. This often involves obtaining a medical cannabis card through a documented diagnosis from a licensed physician. In contrast, recreational cannabis can be purchased by anyone over the age of 21 in states where it is legal, requiring no such documentation.

Taxation and Cost: One of the most tangible differences comes in the form of taxation. Medical cannabis is typically subject to lower taxes compared to its recreational counterpart. This is designed to make medical cannabis more accessible to patients who rely on it for therapeutic purposes. Recreational cannabis, on the other hand, often carries a higher tax rate, contributing significantly to state revenues.

Purchase Limits and Potency: States with both medical and recreational cannabis laws usually impose stricter purchase and possession limits on recreational users. Medical cannabis patients might have higher limits to ensure they have access to the quantities needed for their treatment. Additionally, some states allow for higher potency products to be available for medical use, recognizing the need for stronger products to alleviate certain medical conditions.

Age Restrictions: While recreational cannabis is restricted to individuals 21 and older, medical cannabis can sometimes be accessed by younger patients with specific medical conditions, provided they have approval from a guardian and a physician.

What Category Is Right for Me?

Consider the purpose of use. If you seek cannabis for casual relaxation or enjoyment, and you do not have a medical need, you may opt for recreational cannabis. If you have a qualifying medical condition that could benefit from cannabis treatment, you may want to explore medical options.
